9 Stages of Mediation to Resolve Business Disputes

When it comes to dispute resolution, one of the best yet underused methods of conflict resolution is mediation.   Mediation should always be tried before heading to court, as this resolution method can save money, time and headaches, since a professional mediator can determine the best types of mediation that can amicably resolve the dispute.  Mediators have been helping people who have disagreements between them gauge the advantages that give-and-take presents over arguments and expensive legal action, and how reasoning is better than violence suing the other party.  As a formal method of dispute resolution, mediation has emerged as a specialized institution in the last two decades and has found application in a large range of fields, including disputes between neighbors, family members, and business dealings.  The process of mediation requires parties of the dispute to seek the help of a third party mediator to intervene and facilitate communication and agreement between them. Mediation helps parties resolve conflicts in a peaceful way which ensures that the relationship between them remains amicable, and the dispute itself is resolved in a structured way with an outcome that is acceptable to all parties, and can prevent the time and cost involved in taking the dispute to court.  The process of mediation involves a number of cycles and stages.

Stage 1: Recognition of the problem

Stage 4: Fact finding or gathering of the data

Stage 5: Definition of the problem

Once the shared information is seen and assessed by the mediator, he/she then lays out a definition of the problem in front of the parties. Stage 6: Development of options

Once the problem has been outlined and the parties recognize that it contains the essence of the problem between them, the mediator begins to lay out options in front of them. These alternatives need to be mutually agreeable and not skewed in favor of one of the parties.

At times, the dispute between parties arises when one or more of them are simply not aware of the options that they have available for them in that particular scenario. How to Increase Concentration with Mediation?

Concentration is the ability to focus on one thing at the expense of all distractions. Unless you’re really interested in what you’re doing and totally involved in it, it’s too easy to get distracted and lose focus.  In addition to not being able to turn off work issues when you are with family or friends, stress, fatigue, the phone ringing non stop, the need to check email on your computer or smart phone every 30 seconds, your neighbor’s annoying dog barking at all hours of the day or night, you may also have computer, money or relationship problems, which can contribute to lack of concentration.  Unfortunately, lack of concentration interferes greatly with focus, productivity, health and wellness or success.  However, although concentration can be disturbed, it is not lost forever. You can learn to tune out these distractions completely, regain focus, improve health and wellness and enhance concentration through simple meditation techniques that can take as few as 3 to five minutes a day to start.

The Number Meditation Technique

Sit in a comfortable place that is free from distractions, where you can close the door, dim the lights and close your eyes. It is important to keep your back straight so that you will remain comfortable in this position for several minutes, take your shoes off and place your palm facing up in your lap.  Start with normal slow deep breathing in through your nose and out through your mouth.  As you breathe visualize the number one in your mind. When you are successful on focusing this number, breathe out and visualize the next number.  Continue the same process till you reach the number 100.  Once you have reached one hundred, you may wind up the meditation session.

One thing to be noticed is, you cannot rush to the next number until you have successfully visualized the previous number. If at any time during the meditation process your mind wanders, which you inevitably will when beginning meditation, you must stop the counting process, focus your attention on your breathing to regain concentration and restart from number one.

The objective of trying this technique is to help enhance your concentration by focusing on the numbers you are counting.

 

Object Visualization Technique

The object visualization technique is crafted to help you visualize an object.  Follow the steps as you would do with any other meditation session. Think of visualizing a simple object like a flower, a car or a cup. During the meditation process you need to visualize the object by drawing it with your mind. Make it as beautiful as possible. To begin with, visualize the outline of the object then proceed to the colors, texture, and any pictures associated with the object. Also, see whether there is any text on the object. Finally, find out if the object creates a distinct smell in your mind.  Focus on this smell in your mind.

If at any point during this visualization process, you lose focus and visualize on something else, stop the process and restart from the first step.  Practice this daily for about ten minutes until you are able to concentrate on the object without any distractions.

Trataka Meditation Technique

The Trataka Meditation Technique is also called candle flame gazing, and helps in improving concentration. This meditation technique enhances will power and contributes to inner peace and silence.

Sit in a relaxed position with your back straight.  Bring your hands to Gyan Mudra, such that your thumb is pressed against the index finger to make the letter O, and your other fingers are stretched.  Rest your hands palms faced up gently on your knees with the Mudra facing upwards.  Make the room dark and breeze-free by covering up the windows.

Place a lighted candle on a long candle holder, which is about 3 feet away from you and at eye level.  Start gazing at the candle flame without blinking for as long as comfortable.  Once your eyes shed tears, close them and visualize the flame at the center of the eyebrows, which is referred to as the Third Eye Chakra.  Focus on this image.  The image clarity determines your level of concentration.  If the clarity is not good then you need to repeat the procedure from the beginning.  Once the image disappears, open your eyes and repeat the process again of gazing at the flame. Repeat this cycle for 5-10 minutes. Once you are successful at visualizing the flame, you can extend the duration by 5 minutes till you reach 30 minutes.

Use a candle with good wick length as it will help to retain the afterimage and make it easy to practice the concentration part of the meditation. Don’t over strain your eyes during the gazing period.

Meditation with Om

This technique is incredibly effective in relaxing your mind and body.  Sit on a chair or on the floor with your back straight and feet resting on the floor or fold your legs backwards with your heels facing upwards and your body balanced on the calf muscles. Inhale deeply until the air fills your lungs completely and then exhale slowly saying “Om” till you run out of breath. Repeat this for about 10 minutes. This recitation is known to create a heightened state of awareness and alertness, which in turn will enhance your concentration.

These relaxation techniques will not only help to improve your concentration, but will also keep you relaxed in the most stressful situations.

What is Resistance Training?

Resistance Training, sometimes also referred to as suspension training, is a form of resistance exercise and strength training is a home exercise program that uses resistance bands or suspension straps to build muscle, increase strength, improve endurance and increase flexibility by causing the muscles to contract using an external resistance, in this case resistance bands or suspension training straps and your own body weight.  While many popular home exercise programs are designed for people who are already experienced with exercise, resistance training is perfect for both people who are new to exercise and experienced with exercise, since there are several beginning resistance training exercises that can be done at your own pace.

Resistance Bands

A resistance band training program generally uses bands made of industrial grade rubber or other elastic materials of varying thicknesses that can be attached to an apparatus, or has handles and wraps around the feet.  The thicker the band is will correspond to a greater level of resistance during the workout.  For people new to exercise or resistance training should use the lowest level resistance band to start, and over time as strength and endurance improves, you can move up from the thinnest band that provides the lowest level of resistance to thicker bands that provide progressively more resistance, to continually build strength, muscle mass and endurance.

I used resistance bands  as part of physical therapy treatment to build muscle strength, stability and endurance after a broken ankle.  As strength, endurance and flexibility began to improve in my leg, ankle and foot,  I moved up from the thinnest band that provided the lowest level of resistance, to thicker bands that provided a greater level of resistance when performing the strengthening and flexibility exercises.

 

Suspension Training

Suspension training is another form of resistance training that uses thick adjustable nylon industrial grade straps, called a suspension trainer, that are either attached to an apparatus, a door using a special hook or even a tree.  Rather than using resistance bands, where the thickness of the  bands provides the resistance during the exercises, suspension training relies on the person’s own body weight and the distance from where the straps are attached to the apparatus or door as the source of resistance.  The closer the person is to the point of where the suspension straps are attached to the apparatus or door, and the setting of the straps determines the level of resistance, from beginner to expert.  Suspension straps come with handles for hands, and stirrups for shoes to provide a complete upper body, core and lower body workout.

 

I have been taking a suspension training class at my gym, and in a typical 30 minute class, I work all key muscle groups: chest, shoulders, arms, core, lower back and legs.

How to Prevent Type 2 Diabetes in Children and Adults

Type 2 Diabetes is a chronic condition that effects nearly 24 million people and was once primarily associated with the adults over the age of 40.  However, in recent years, children have also fall prey to this serious chronic metabolic disorder.  Unlike Type 1 Diabetes, this fully preventable form of a diabetes which accounts for over 90% of all cases of diabetes, affects the sugar metabolism rate of the body, called insulin resistance.  Since this type of a diabetes problem is more associated with the adults, due to obesity, poor diet and lack of exercise, it is often referred to as adult-onset diabetes.  However, Type 2 Diabetes is becoming more frequent among children. The main reason is surely due to obesity, poor diet and lack of exercise.

There are certain steps and precautionary measures available that, if followed properly, can help in preventing or controlling Type 2 Diabetes among children and adults.  Children should be encouraged to follow a healthy diet and lifestyle.  Get them involved in a lot of physical activities followed by a healthy diet free of trans-fats, LDL cholesterol, sugar and sodium (salt) usually found in fast food and packaged foods.  Instead children (and adults) should eat lean meat or fish, plenty of green vegetables, fruits, healthy oils such such as olive oil instead of corn oil and 6-8 glasses of water intake daily.  Make sure children avoid sugary drinks and soda, as well as,  junk foods.  By following this program, doctors say this can reverse or prevent Type 2 Diabetes in children and adults, and may eliminate the need to take insulin to boost the body’s ability to convert  blood sugar to energy, since diet and exercise will help the body use the excess glucose already in the body and improve insulin sensitivity.

3. Connecting with Several Parts of Yourself.  Everyone on earth is certainly not a solo instrument. People are similar to a choir or any orchestra, where you could see several types of voices coming out at the same time. You need to check and hear or feel what the different parts of your body including your mind, heart, and gut are saying.  For instance, you may see your mind saying to leave your partner, but your heart says that you really love her.  Allow your different kinds of voices to speak to one other. This will help you in finding out the right answer that comes from your whole personality and not from a single part in you.

4. Cultivate and Develop Compassion.  Take time to practice by observing yourself and your partner without being judgmental.  Some portion of your body could be the judge; however, you are not supposed to identify the same since these judgments close the doors of wisdom.  Contrary to judgment is compassion. You live with compassion; you often remain connected, open and always accessible for a respectful dialogue with your partner or spouse.  If you put yourself into the practice of seeing your partner with compassion, you end up getting a greater amount of power to select your response instead of simply reacting.

5. Develop a ‘We’ rather than Living with Two ‘I’s.’   The base of ideas like growth, development and having a mutually supportive relationship has to be connected and at the same time separate.  In any co-dependent kind of relationships, one person seems to be sacrificing something for their partner and compromising themselves for the relationship.  This can lead to an unhealthy relationship.  However, if you choose to remain connected and separate as well, each individual ‘I’ simply adds to embark with a creation of a strong unity of ‘we’, which happens to be much stronger and better than the two separate ‘I’s.  The differences between the two partners are certainly not the negatives.  At times you may fear that the differences between you and your partner could make you feel that you are an incompatible couple, however, these things simply can make your relationship exciting.

6. Invest some Time for your Relationship.   Regardless of the fact that you are a busy person or your commitment at your workplace keeps you from your family or partner, you have to create balance and spend some quality time investing in your relationship.  This will foster love and intimacy between you and your partner that is needed to keep your relationship alive.  Take time to try new things like date night,  having a romantic dinner together or a holiday vacation could help you in nurturing your relationship.  Make sure you create a sacred kind of mutual space for both of you, and shutting out all the digital and electronic gadgets that only add distraction and distance. Like any garden, the more quality time you spend with each other, the more you will find enjoyment and love in your relationship.
